Merchants Exchange Learning System

1. Acceptance of Terms

By accessing or using the Merchants Exchange Learning System (“MEX Learning,” “we,” “us,” or “our”), including creating an account, purchasing courses, attending live sessions, or communicating with staff, you agree to be bound by these Terms and Conditions.

If you do not agree to these Terms, you may not use the platform.

2. Account Registration

To access certain features of the platform, you must create an account.

You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the confidentiality of your login credentials
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Course Purchases and Payments

All course purchases are processed securely through Stripe.

By purchasing a course, you agree that:

  • You are authorized to use the payment method provided
  • All information provided for payment is accurate
  • You will not dispute valid charges

Course pricing is subject to change at any time. Refund policies, if applicable, will be outlined at the time of purchase.

4. Access to Courses

Upon purchase, you are granted a limited, non-transferable, non-exclusive license to access and view the course materials for personal or organizational training use only.

You may not:

  • Share or distribute the course materials
  • Reproduce, duplicate, copy, sell, or rent the course materials
  • Modify, adapt, translate, or create derivative works from the course materials
  • Use content for commercial resale or redistribution

Violation may result in account termination without refund.

5. Live Courses and Streaming

Some courses are delivered live via streaming video.

By participating in a live course, you acknowledge and agree:

  • Your image, likeness, and voice may appear in live video or recordings
  • Sessions may be recorded for training, archival, or promotional purposes
  • We may use images or video clips from live sessions for marketing, website, social media, or promotional materials

Participation in live video implies consent to be recorded and photographed.

If you do not wish to appear on camera, you are responsible for disabling your camera or notifying staff in advance.

6. Media Release for Live Courses

By registering for and attending a live course, you grant Merchants Exchange Learning System permission to:

  • Photograph or record your participation
  • Use such images or recordings in promotional materials
  • Publish materials on websites, newsletters, social media, and marketing collateral

No compensation will be provided for such use.

7. Participants Under 18

Participants under the age of 18 must have parental or legal guardian consent.

If a participant indicates they are under 18:

  • A parental consent email will be sent
  • Access to live participation may be restricted until consent is confirmed

Parents or guardians may request removal of a minor’s image from promotional materials by contacting us in writing.

Users may communicate with staff through platform messaging, email, or live chat features.

You agree not to:

  • Harass, threaten, or abuse staff or other users
  • Submit unlawful, defamatory, or inappropriate content
  • Attempt to gain unauthorized access to systems

We reserve the right to remove users engaging in inappropriate conduct.

9. Intellectual Property

All content on the platform, including:

  • Course Materials
  • Videos
  • Live Session Recordings
  • Written Materials
  • Logos
  • Graphics

is the property of Merchants Exchange Learning System or its licensors and is protected by intellectual property laws.

10. Disclaimer of Warranties

Courses are provided for educational and training purposes only.

We do not guarantee:

  • Employment outcomes
  • Certification approvals (unless explicitly stated)
  • Regulatory compliance outside stated course objectives

All services are provided “as is” without warranties of any kind.

11. Limitation of Liability

To the fullest extent permitted by law, Merchants Exchange Learning System shall not be liable for:

  • Indirect or consequential damages
  • Loss of data
  • Loss of business
  • Technical interruptions

Our total liability shall not exceed the amount paid for the course in question.

12. Platform Availability

We do not guarantee uninterrupted access to the platform. Maintenance, technical issues, or third-party service outages may occur.

13. Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Engage in unauthorized content sharing
  • Disrupt live sessions
  • Attempt to misuse the platform

14. Privacy

Your use of the platform is also governed by our Privacy Policy.

15. Changes to Terms

We may update these Terms at any time. Continued use of the platform constitutes acceptance of updated Terms.

16. Governing Law

These Terms shall be governed by the laws of the State of [Insert State], without regard to conflict of law principles.
